These General Terms and Conditions of Sale govern the sale of products to you by Y Services Ltd., an affiliate of YOOX s.p.a., (“Provider”) through the United States section of store.diesel.com (“Site”). As used herein, the words “we”, “us” or “our” refer solely to Provider and not to you. You are advised that Provider is not affiliated with Diesel s.p.a. or any of its subsidiary companies. This Site is available only for purchases within the United States. Any terms and conditions not included herein are excluded. Your use of this Site to purchase products indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale.
ORDERS
All orders are subject to e-mail confirmation by us. Please note that the products displayed on this Site may be out-of-stock or discontinued.
PRICES
All prices are in US Dollars. Prices may change without notice. The total invoice price (Total amount due) is inclusive of Sales Tax applied with individual state and local regulations if your shipping address is in one of the following states: California, Colorado, District of Columbia, Florida, Hawaii, Illinois, Massachusetts, Michigan, New Jersey, New York, Nevada, Oregon, Pennsylvania, Texas, Virginia, Georgia. We are currently not required to collect sales tax on items shipped to other destinations. An estimation of the tax charges will be indicated according to the State of the shipping address in the Payment page of the Shopping Bag. This estimation will also be equal or less than the appropriate Sales Tax applied. Appropriate tax charges will be calculated automatically after validation of your order and the final order total is communicated in the invoice you will receive with the shipping confirmation e-mail. Depending on the tax laws in each state, you may be required to pay use tax on purchases for which sales tax has not been collected. All prices are inclusive of customs and import duties.
SHIPPING COSTS
You are responsible for the shipping costs associated with the delivery of the products you purchase on this Site as specified on your order confirmation.
SHIPMENTS AND DELIVERY
You bear all risks of loss and damage to the products from the time the same have cleared our fulfillment house. Delivery is deemed complete and title to the products passes to you upon acceptance of shipment by a common carrier.

BINDING AGREEMENT

The laws of the State of New York (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions of Sale shall be brought solely in the City of New York, State of New York.
SEVERABILITY
